Terms of Service

These Terms of Service ("Terms") govern your access to and use of the visa-bond.com website and the visa-bond placement services (collectively, the "Service") provided by Elephant Enterprises LLC, a Delaware limited liability company ("VisaBond," "we," "us," or "our"). By accessing the Service or submitting an application, you agree to be bound by these Terms.

1. Who we are

visa-bond.com is a private service operated by Elephant Enterprises LLC. We are not the U.S. Department of State, the U.S. Treasury, U.S. Citizenship and Immigration Services, or any other government agency, and we are not affiliated with or endorsed by any of them. We do not issue visas, make immigration decisions, or provide legal or immigration advice.

2. The Service

The Service assists individuals who have been approved for a U.S. B-1/B-2 visa and required to post a visa bond under the Visa Bond Program. Where you engage us, VisaBond arranges for the required immigration bond to be posted on your behalf with the U.S. Treasury via Pay.gov and the applicable DHS Form I-352, with VisaBond (or an obligor you designate) acting as the obligor.

3. Eligibility

You may use the Service only if you have passed your B-1/B-2 visa interview, have been required to post a visa bond, and can provide accurate and complete information. You represent that all information you submit is true and that you are legally permitted to enter into these Terms.

4. Fees

Use of the Service requires payment of a service fee, which is disclosed before you commit. The service fee is non-refundable. The service fee is consideration for placing and administering the bond; it is not a deposit, and it is separate from the bond amount itself.

5. Bond repayment and your obligations

The visa bond is a financial guarantee to the U.S. government that you will comply with the terms of your visa, including departing the United States on time and entering and exiting through commercial air ports. If you breach those terms (for example, by overstaying), the bond may be forfeited to the government. In that event, you — and any obligor who funded the bond — are liable to reimburse VisaBond for the full forfeited bond amount (which may be $5,000, $10,000, or $15,000), together with any costs of collection. The service fee does not cover, reduce, or insure against this liability.

6. No guarantee of entry

Posting a bond satisfies a condition placed on an already-approved visa. It does not guarantee that you will be admitted to the United States; admission is always determined by U.S. Customs and Border Protection at the port of entry. Nationals of countries subject to a U.S. entry ban may be unable to receive or use a visa even with a bond.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any application will be accepted by any government channel.

9. Limitation of liability

To the maximum extent permitted by law, VisaBond and Elephant Enterprises LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill. Our total aggregate liability arising out of or relating to the Service will not exceed the amount of the service fee you paid to us.

10. Indemnification

You agree to indemnify and hold harmless VisaBond, Elephant Enterprises LLC, and its members, officers, and agents from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your breach of these Terms, or your breach of the terms of your visa or bond.

11. Governing law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict-of-laws principles. You agree that the state and federal courts located in Delaware will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.

12. Changes to these Terms

We may update these Terms from time to time. Changes are effective when posted to this page with a revised effective date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
